Notice of Intention to Make a Dog Control Order regarding Petersham Meadows, Richmond, Surrey

Notice is hereby given that The London Borough of Richmond upon Thames Council (the Council) proposes to make an Order under part 6 of the Clean Neighbourhoods & Environment Act 2005, the effect of which will be to create an offence if a person in charge of a dog takes the dog onto, or permits the dog to enter or remain on, Petersham Meadows between the months of April and October inclusive each year.

No offence is committed if the person in charge of the dog has a reasonable excuse; or consent has been given by the owner, occupier or other person or authority having control of the land.

This Order does not apply to any person who:

- is registered as a blind person in a register compiled under section 29 of the National Assistance Act 1948

- has a disability which affects his mobility, manual dexterity, physical co-ordination or ability to lift, carry or otherwise move everyday objects, in respect of a dog trained by a prescribed charity and upon which he relies for assistance

- is deaf, in respect of a dog trained by Hearing Dogs for Deaf People (registered charity number 293358) and upon which he relies for assistance

Each of the following is a prescribed charity for the purposes of this Order:

- Dogs for the Disabled (registered charity number 700454)

- Support Dogs (registered charity number 1088281)

- Canine Partners for Independence (registered charity number 803680)

Penalty

A person in charge of a dog who breaches a term of the Order shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale (currently £1000).
